A Partition Action is a legal proceeding where a Court orders the separation of land that is currently held by two or more persons so that they are no longer co-owners to this land. A Partition Action is typically brought by one of the co-owners who simply no longer want to be in a co-ownership relationship with the other. Any co-owner can ask for this separation regardless of how much land they own.
A Court can provide several remedies in a Partition Action. One remedy is to create smaller parcels so that each co-owner will have their own separate lot. Another remedy is to sell the land by a judicial or private sale, and then distribute the cash proceeds among the co-owners. Sometimes, the Court may provide both of these remedies whereby some of the land is allotted to the owners and some of it is sold. Any of these remedies is within the discretion of the Court, and depends on the size and type of the land, the number of co-owners and the applicable county zoning restrictions, state regulations and federal law.
